The Texas Department of Licensing and Regulation (TDLR) regulates mold assessment and remediation under the Texas Mold Assessors and Remediators Occupations Code and Administrative Rules.
For residential property owners, the law provides an exemption: homeowners may perform mold remediation on their own property without being licensed, regardless of the size of the project. However, once a homeowner hires another individual or company to perform remediation, the rules take effect. In that case:
- If the total surface area of visible mold contamination to be cleaned or removed is less than 25 contiguous square feet, the property owner may hire anyone to perform the work.
- If the total affected area is 25 contiguous square feet or more, the work must be performed by a licensed Mold Remediation Contractor (MRC).
For non-residential properties, an owner, tenant, or managing agent may perform remediation on property they own or lease only if the affected area is less than 25 contiguous square feet. Once the 25-square-foot threshold is exceeded, the work must be conducted by a licensed Mold Remediation Contractor.
When remediation is performed by a licensed Mold Remediation Contractor – whether above or below the 25-square-foot threshold – the law also requires that a licensed Mold Assessment Consultant (MAC) first conduct an inspection and prepare a written remediation protocol (work plan). There are significant benefits to using licensed professionals. Licensed Mold Remediation Contractors bring the training, equipment, and expertise necessary to manage mold safely and effectively. In addition, projects handled by licensed assessors and remediators are eligible for a Certificate of Mold Damage Remediation (CMDR), which can protect property value, satisfy disclosure obligations when selling a home, and help prevent insurance complications in the future.
